In the current issue of ZFR (Zeitschrift für Finanzmarktrecht - Journal of Financial Market Law), Fabian Liebel deals with the question of when the holder of a small-value savings account has a payout claim against the bank.
The contribution goes back to the decision of the OGH in 3 Ob 208/21s, which was based on a curious case: After the purchase of a business premises, the plaintiff had found 27 (!) small-value savings books in a washing machine drum. They were in a leather bag and conveniently all lottery words were also noted in it.
