In the current issue of ZFR - Zeitschrift für Finanzmarktrecht, published by LexisNexis Österreich Verlag - DSC lawyer Fabian Liebel focuses on a recent decision of the Austrian Supreme Court dealing with a special problem in savings book law: A bank concluded a savings deposit agreement with a legally incapacitated person, accepted deposits and issued savings certificates. Third parties then (allegedly) acquired ownership of the savings books.

The court dealt with the question of the consequences of issuing savings certificates based on a void savings deposit agreement.
